1.1 This Privacy Policy sets out how JAC Motors Dandenong handles your personal information. This includes how we collect, store, use and disclose your personal information in accordance with the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (Privacy Act) which we are bound by.

2.Who we are
2.1 PATTERSON CHENEY PTY. LTD. (ABN 52 005 805 247) (JAC Motors Dandenong, we, us, our) is an authorised JAC Motors dealer selling new and used JAC branded vehicles.
2.2 'JAC' refers to JAC Auto (Pickup) Pty Limited (ABN 26 667 906 934). JAC is the official importer and distributor for JAC branded vehicles, parts and accessories in Australia. JAC distributes and sells a range of vehicles and related products in Australia through its appointed dealer networks (Authorised JAC Dealers).
2.3The JAC Network includes:
(a)JAC and its related companies;
(b)us and all Authorised JAC Dealers; and
(c)any third party finance provider appointed by JAC.
2.4The JAC Network collects and shares your personal information with other members of the JAC Network so that the JAC Network can provide you with an integrated JAC customer experience. This experience includes allowing you to be known across the JAC Network regardless of which JAC entity you choose to deal with and to provide you with products, services, information and assistance, respond to your enquiries and help keep your information up to date. As further discussed below in section 8 “When we disclose your personal information?”, your information may be disclosed to JAC Network service providers in Australia and overseas for these purposes.

3.Your personal information
3.1Personal information collected and held by us about you, may include:
(a)your contact and identification information, such as your name, gender, date of birth, address, telephone numbers, e-mail address, occupation; drivers licence number, drivers licence state, and ABN.
(b)payment related information, such as your credit card information, and banking information;
(c)national register business and company numbers;
(d)documents to support a finance application;
(e)vehicle, warranty and servicing related information (including information provided to us by JAC or third parties) such as your vehicle registration and identification number, vehicle purchase details, name of your selling or servicing Authorised JAC Dealer, vehicle service and repair history, service appointment bookings and vehicle warranty, recall information;
(f)information collected by us from customer surveys, product research, marketing campaigns, your interactions with us including through social media and IP addresses;
(g)employment application information if you apply for a job with us; and
(h)any other relevant information.
3.2We may collect and hold sensitive information about you including:
(a)details of current or previous insurance (for motor insurance);
(b)driver’s licences;
(c)salary and personal finances (for finance or loan applications).
3.3If you choose not to provide us with your personal information, we or JAC may not be able to provide you with the services you require, or the level of service on which we pride ourselves.
4.How we collect personal information
4.1 We collect personal information in a number of ways, including:
(a)directly from you, when you visit one of our dealerships or collision repair facilities in person, or provide information to us by telephone, electronic messages (including email and SMS) or in documents;
(b)directly from you, via our internet site or through interaction with our various social media platforms (for example when you submit a request to receive our offers, to receive our brochures and/or other materials, or to book a test drive);
(c)if you purchase a vehicle or other product or service from us or have your vehicle serviced or repaired;
(d)from your agents or representatives who act on your behalf;
(e)from your employer, contractor or another person who makes a vehicle available to you;
(f)from competition entry forms or at our promotional activities or sponsored events;
(g)from third parties, including;
(1)members of the JAC Network;
(2)a credit reporting body to conduct a car history check over your vehicle;
(3)if you complete a form on, or interact with, a third party website such as Carsales.com.au, a car manufacturer website or Google;
(4)from your employer or referees to confirm details of your employment for finance applications or employment with us;
(5)manufacturers, distributors and authorised dealer network and service providers;
(6)marketing organisations including through the use of purchased lists industry databases;
(7)publicly available sources such as the internet and telephone directories
(h)through surveillance cameras;
(i)from publicly available sources such as the Internet and telephone directories; and
(j)from law enforcement, dispute resolution, statutory and regulatory bodies who make this information lawfully available to us.
5.Information we collect automatically
5.1 Whenever you visit or interact with our website or other online platforms (Platforms), we, as well as third-party service providers and/or advertisers, may use a variety of technologies that automatically or passively record information about how the Platform is accessed and used (Usage Information).
5.2 Usage Information may include your IP address or other unique identifier for the device used to access a Platform (Device Identifier), browser type, device type (computer, mobile phone, tablet or other device), operation system, application version, date and time of visit, pages viewed, preceding page views and your use of features or applications on the Platform such as interactions with connections or groups.
5.3 Usage Information helps us keep our Platforms relevant to users and allows us to tailor content to a user’s interests. Usage Information is generally non-identifying, but if we associate it with you as a specific and identifiable person, we will treat it as personal information.
5.4 We may use Device Identifiers to help us administer Platforms, diagnose problems with our servers, analyse trends, observe Platform usage and activity over time, help identify you and your shopping cart, and gather broad demographic information for aggregate use.
5.5Cookies:
(a)We or our external service providers may collect cookies from you (data files placed on a Device when it is used to visit a Platform) for security purposes, to facilitate site navigation and personalise your experience while visiting our Platforms (such as allowing us to select which ads or offers are most likely to appeal to you, based on your interests, preferences, location or demographic information).
(b)To learn how you may manage cookies, or delete cookies that have already been installed, please refer to your browser’s help menu or instructions. If you disable or opt out of receiving cookies, some features and functions on our Platforms may not work properly. In addition, the offers we provide may not be as relevant to you or tailored to your interests.
5.6Remarketing:
(a)We use search engines and social media to advertise our products and services online. Third party vendors, Meta, Google, Facebook, YouTube and Instagram use cookies to display relevant ads based on your past visits to our Platforms. Remarketing allows us to tailor our marketing to better suit your needs and display ads that are relevant to you.
(b)Any data collected will be used in accordance with this Privacy Policy, or the privacy policy of other remarketing services that we may use.

6.How we use your personal information
6.1Your personal information may be used by us in order to:
(a)provide and market our products and services and market products of members of the JAC Network (whether directly or through our related companies);
(b)communicate to you in relation to our and members of the JAC Network’s products, services and promotional activities;
(c)responding to your enquiries, concerns or complaints and administering and managing our relationship with you;
(d)support your purchase through warranty and roadside assistance (whether directly or through the JAC Network);
(e)comply with our legal obligations (i.e. in the event of a Vehicle Safety Recall);
(f)monitor our performance and to help us manage our services;
(g)identify and contact individuals who do business with us;
(h)train employees, agents, dealers and representatives of the JAC Network;
(i)conduct customer and market research and analytics to improve the quality of our and JAC Network’s products and services;
(j)assess and process employment applications and manage employment issues;
(k)handle complaints and disputes; and detect, investigating and preventing fraud; and
(l)any other purpose which we notify you about when we collect your information or to which you have provided your consent.
6.2We may contact and communicate with you either via telephone, post, facsimile, email (including a private message on your social media profile(s)) or SMS.
7.Direct marketing
7.1 The JAC Network (or any of the entities which make up the JAC Network including their agents and contractors (if any) acting on their behalf) may send you direct marketing to inform you about products or services, special offers, programs, promotions and events that may be of interest to you. These marketing communications may include joint promotions with JAC or other promotion partners and may be sent to you using any contact details provided by you, such as post, phone, email or SMS.
7.2Please note that the organisations comprising the JAC Network are separate organisations. If you do not wish to receive marketing communications and surveys from a member of the JAC Network, you can let that organisation know at any time using the contact details in their respective privacy policies or utilising the “unsubscribe” or other opt-out function offered by the organisation in each marketing communication.
7.3We will not direct market to you unless you have been given an opportunity to opt out of receiving future direct marketing communications or unless you have otherwise consented to direct marketing. If you do not want to receive such offers from us or do not want us to disclose your personal information to members of the JAC Network for marketing purposes, you can opt out at any time by contacting us using our contact details provided below or using the "unsubscribe" function in electronic communications. (2) warranty loan vehicle providers;
(3) roadside assistance;
(4) customer research;
(5) financial services and insurance;
(6) mailing systems;
(7) direct marketing and promotions; and

(c)government, regulatory or law enforcement authorities and organisations, as required or authorised by law;
(d)the agent(s), contractors, representatives or employees, of any of those entities referred to above;
(e)a person that subsidises or makes a vehicle available to you, such as your employer (where applicable); and

8.2Those entities are not authorised by us to use personal information for anything other than the purpose for which we supplied that information to them. We may also disclose personal information where you consent to us doing so. That consent may be written, verbal or implied from your conduct.
9.Disclosure to overseas recipients
9.1Our related entities and some of our service providers (including information technology service providers) may be located overseas and, as a result, personal information collected and held by us may be transferred overseas.
10.How we hold and store your personal information

(b)notify us if you have purchased or acquired your JAC vehicle outside of the JAC Network; and
(c)If you do not notify us of a sale, purchase, acquisition or transfer of a vehicle, we may continue to send communications in relation to that vehicle to the last known registered owner in our records.
12.You can access your personal information
12.1You have a right to access your personal information, subject to some exceptions, such as if the information relates to anticipated legal proceedings or the request for access is frivolous or vexatious. If you would like to access your information, please let us know. You may be required to put your request in writing for security reasons and we may charge a fee for our reasonable costs in searching for and providing access to your information.

14.Making a Complaint
14.1If you believe that we have interfered with your privacy in our handling of your personal information, you may lodge a complaint.
